May 17, 2023: HMJ (retd.) Indu Malhotra instituted the ‘Om Satya Scholarship’ at National Law University Delhi on Wednesday, 17 May, 2023. The Scholarship will be awarded to a female student and will serve to fund the whole five years of the students’ law degree. The Scholarship has been instituted in the name of Justice Malhotra’s parents; Om Prakash Malhotra, senior advocate, Supreme Court of India and author Satya Malhotra.
On the occasion, Justice Malhotra also delivered a special lecture on the Overview of Arbitration Landscape in India for NLU Delhi students, where she discussed the historical origins of the arbitration regime in India and the latest Amendments in the Arbitration and Conciliation Act 1996.
The discussion was highly informative, lively, and engaging.
Justice Malhotra offered her critique of the Arbitration Act 1940 which triggered the emergence of a new arbitration regime in 1996 based on the UNCITRAL Model Law 1986. This transformation, Justice Malhotra pointed out, has placed India on the global map of arbitration-friendly jurisdictions and has served the purpose of improving India’s ranking on the Ease of Doing Business Index.
She also discussed the principle of minimal judicial intervention in the arbitral process, the necessity of promoting institutional arbitration in India and the role of the Indian International Arbitration Center in making India a seat of arbitration.
