The Journey of Indian Constitution: We the People and Free Markets

A colloquium to celebrate Prof M.P. Singh’s 75 years of Journey

 

The National Law University Delhi organized a one day Colloquium on the theme “The Journey of Indian Constitution: We the People and Free Markets” on Saturday 19th September 2015 to celebrate 75 years of journey of Professor (Dr.) Mahendra Pal Singh popularly known as Professor M.P. Singh, a foremost constitutional law scholar. The Colloquium was conceived and given shape by his former students from India and abroad among whom Hon’ble Mr. Justice A.K. Sikri, Judge, Supreme Court of India gave the key note address and also presented a memento to Professor M.P. Singh. Hon’ble Vice Chancellor of NLU Delhi, Professor (Dr.) Ranbir Singh opened the Colloquium by his welcome address.

 

Professor M.P. Singh is currently the Chair Professor at the Centre for Comparative Law at NLU Delhi. The theme of the Colloquium sought to capture various facets of the journey of Indian Constitution in relation to ‘We, the people’ and free market economy of which the former signifies the constant character of Indian polity while the latter represents the economic policies since the early 1990s in the changing and organic nature of constitutional governance in the country.

Presenters, who were all Professor M.P. Singh’s former students, discussed the above two issues in their various and varying dimensions. The 2nd NLU Delhi - Herbert Smith Freehills International Negotiation Competition 2015

 

The 2nd edition of the NLU Delhi – Herbert Smith Freehills International Negotiation Competition, organised jointly by National Law University, Delhi and Herbert Smith Freehills LLP, was held from 11-13 September 2015.

 

The Competition saw the participation of twenty-three teams from six countries, including the UK, Germany, India, Pakistan, Australia and Hong Kong. On the first day of the Competition, the participants faced each other in two grueling preliminary rounds, with negotiation simulations based on international commercial and legal issues.

 

From the preliminary rounds, four teams progressed to an exciting semi-final round. The second day of the Competition began with matches between the University of Cambridge and Oxford University, and between King’s College London and Deakin University. After the closely fought semi-final rounds, the University of Cambridge and Deakin University proceeded to the final round.

 

Hon’ble Justice V. Gopala Gowda (Judge, Supreme Court of India), Mark Bardell (Partner at Herbert Smith Freehills) and Neena Gupta (General Counsel at InterGlobe) judged the excellent final round, from which the University of Cambridge emerged the winners of the Competition with a prize of INR 100,000 (~1000 GBP).

The team from the Universty of New South Wales won the prize for the Best Negotiation Plan, while Senjuti Mallick of ILS Pune was adjudged the Best Negotiator, with both receiving a prize of INR 20,000 (~200 GBP). The newly introduced ‘Spirit of the Competition Award’ was received by NLU Jodhpur. The prizes were sponsored by Herbert Smith Freehills LLP.

 

Mark Bardell, Partner at Herbert Smith Freehills and a judge in the final round, said, “The competition was a great success. From the many students from around India and around the world who flew in to participate, to the many lawyers who gave up their weekends to judge and to the superhuman efforts of the organising committee at NLU Delhi: I heard only praise for the quality of the competition. It is something that Herbert Smith Freehills is particularly proud of supporting.”


National Dialogue for Formulating Guidelines for Incest Cases- 03.09.2015

   National Law University, Delhi in association with Counsel to Secure Justice (CSJ) and HAQ: Centre for Child Rights organised a National level Dialogue for formulating guidelines for incest cases on  03rd September 2015 from 10:00am to 5:30pm at NLU Delhi.

 

Currently, HAQ and CSJ are giving free legal aid and psychosocial support services to more than 80 CSA victims in Delhi.  Disturbingly, nearly 30% of these cases are incest cases. While representing these children, it has been learned that incest cases require special and more sensitive handling than other types of CSA cases, for which at present no legal provisions or guidelines exist.

 

This dialogue was organised to bring together all the stakeholders who handle incest/child sexual abuse cases for the purpose of preparing guidelines to handle such cases and to decide how these guidelines should be implemented

The Center for Corporate Law and Governance  (CCLG), NATIONAL LAW UNIVERSITY, DELHI organised one day Competition Law  and Innovation Programme on Aug 8, 2015.

The programme was co-organised by Professor (Dr.) D. Daniel Sokol- Professor of Law, University of Florida, USA and Professor (Dr.) Harpreet Kaur- Professor of Law, NLUD and Research Director, CCLG. The Programme had two conferences, namely, academic conference and policy conference.  Academic conference was in the form of roundtable on Competition and Innovation while the Policy Conference had two panel discussions, namely, Competition and Innovation and Competition and Disruptive Technologies. Mr. SK Murthy from Intel, Dr. Seema Gaur from CCI and Dr. Geeta Gouri, former CCI member with Prof. Daniel Sokol were the panellists in panel 1. Dr Arul G Scaria, Asst Prof, NLUD moderated the session. Second panel included Ms Angela Diveley, Attorney to Commissioner of US Federal Trade Commission. Dr. Navneet Sharma from IICA, Prof. SP Ketkar from LBSIM and Mr. Deepak Maheshwari from Symantec. This panel was moderated by Prof. Harpreet Kaur. The programme was well attended by academicians, industry and lawyers. Around 50 guests were present in the Programme.

Capacity Development Programme for Corporate Laws

Capacity Development Programme for Corporate Laws (8th-13th June, 2015)

 

National Law University, Delhi under the aegis of National Academy of Law Teachers (NALT) and the Center for Corporate Law and Governance (CCLG) organized a six days ‘Capacity Development Programme for Corporate Laws’ from 8th-13th June, 2015. The course was intended to serve as a primer which aimed at building the fundamentals in areas such as Companies Act, Contract Act, Security Regulations, Banking, Taxation, Insurance, Competition law and Cyber laws. Around 50 Faculty members pan India were sensitized on diverse aspects involved in this area of law. The week long capsule course introduced the participants to diverse areas of corporate laws, and also prepared them for future advanced courses which the Academy and the Center for Corporate Law and Governance would endeavour to bring in. 

 

Objectives of the Programme were as under:
• Introduction and understanding of different Corporate Laws
• Development of theoretical knowledge & practical skill set
• Interaction with diverse group of practitioners & academicians
• Peer group learning
• Preparation for future advanced courses

 

Resource persons included academicians, lawyers, practitioners, experts from regulatory authorities and partners of audit firms. The programme met with a great success. The participants have requested to organise advanced courses.


Advanced Course on Current Developments in the Substantive and Procedural Criminal Laws- International and National Dimensions’ from 1-5 June 2015

National Law University, Delhi has established a National Academy of Law Teachers (NALT) to improve quality of teaching and research. The National Academy of Law Teachers provides training in teaching, research and curriculum development. Keeping this in view, NALT has organized several programs in the past. This time the University organized a five days ‘Advanced Course on Current Developments in the Substantive and Procedural Criminal Laws- International and National Dimensions’ from 1-5 June 2015

 

The course consisted of 20 sessions. The idea behind organizing this course was to apprise the teachers about the current developments and latest judicial interpretations aimed at resolving the crime tangle. This course resulted in to special relevance to the Criminal Law and Criminology teachers. 

 

 

The course was mentored by Prof. B.B. Pande.  Prof. G.S. Bajpai (Registrar) was the course director of this course and this course was coordinated by Mr. Sidharth Dahiya (Research Associate). 


Workshop on Goods and Services Tax in Association (GIFT)

National Law University (NLU), New Delhi along with Lakshmikumaran & Sridharan, Attorneys, as Knowledge Partner, organised a Seminar on 22nd of May, 2015 to discuss the emerging structure of GST. The issues which came for discussion during the seminar included understanding GST, its implications and the possible strategies for smooth transition and elective compliance with the new CGST and SGST laws. The idea behind organizing this seminar was to apprise the participants and the industry about the intention of the Indian Government to introduce the Goods and Service tax. The seminar brought together experts, lawyers, Indian industry and legal scholars such as Mr N. Mathivanan-Principal Partner, L&S, Mr Shivam Mehta-Joint Partner, L&S, Mr Kapil Sharma-Joint Partner, L&S. Twenty eight participants for different industries participated in the seminar along with faculty members and students of NLUD.

1st CADR Symposium on Arbitration Laws

In an effort to bring together practitioners, and academia, for assessing and enriching the discourse on the development of arbitration law in India, the Centre for Alternate Dispute Resolution located at National Law University, Delhi hosted a one day symposium on Arbitration Laws on 16 May 2015.

 

The Symposium comprised of two sessions which dealt with topical issues in the field of arbitration.

 

  • Interpretation of Pre-BALCO agreements in relation to express/implied exclusion of Part I of the Arbitration & Conciliation Act, 1996
  • Reference of Non-signatory parties to arbitration

Public Procurement Bill Consultation

On 14th May, 2015, the Centre for Banking and Finance Laws at NLU Delhi organized a National Consultation on Public Procurement Bill, 2012 in collaboration with the Ministry of Finance. The aim of the Consultation was to provide a platform to stakeholders from different sectors to discuss their views on the Public Procurement Bill, 2012.

 

In his Presidential address Professor (Dr.) Ranbir Singh, Vice-Chancellor, NLUD talked about a number of recent scams that have taken place in India, thereby, recognizing the importance of a law on public procurement. Thereafter, Mr Sanjay Aggarwal, Director, Procurement Policy Division, Ministry of Finance highlighted the vision of Hon’ble Finance Minister Mr Arun Jaitley to reintroduce the Public Procurement Bill in the Parliament. In his keynote address, Mr Harsh Kumar, Director, National Institute of Financial Management (NIFM), Faridabad provided a brief background on legal framework on public procurement in India and the need to have a Central Law on Public Procurement in India. Prof. G.S. Bajpai, Registrar, NLUD, shared his ideas on the subject and presented Vote of Thanks.

 

The event witnessed participation from various stakeholders and institutions like Competition Commission of India (CCI), Indian Railways, BSNL, NIC, Indian Institute of Corporate Affairs (IICA), CUTS, academicians and researchers from various Universities. The Post-Graduate students of LL.M. participated enthusiastically since it was a great learning experience for them.

 

The Programme was divided into two technical sessions. The first session on principles and methods of procurement discussed the Constitutional aspects of the Bill as well as various definitional and structural issues in the Bill by stakeholders from the Ministry of Railways and Competition Commission of India. Prof M.P. Singh chaired the session with other invited speakers. The second session on Institutional Mechanism, Grievance Redressal and Penalties discussed the lacunae’s in the Redressal Mechanism provided for in the Bill and the need of a Public Procurement Policy for India. This session was chaired by Sh. Dhanendra Kumar, Former Chairperson, CCI. A consultation questionnaire was prepared by the organizers that was circulated amongst the participants for their responses. The outcomes would be submitted to the Ministry of Finance for their perusal. The event was a great success.

 

 The Consultation coordinators were Dr Ritu Gupta, Associate Professor, NLUD and Dr Aparajita Bhatt, Assistant Professor, NLUD. Mr Dinesh Singh, Research Associate, NLUD and Ms Navpreet Singh, student LL.M., NLUD helped in organization. The sessions were followed by Lunch and Tea.

Capsule Course on Legal Aspects & Legal Matters

National Law University, Delhi is organised a capsule course for revenue officers at National Law University Delhi from 20-25 April, 2015 at National Law University Delhi. 

 

The objectives of the course were:

   •      To familiarising revenue officials with general procedural safeguards and cares to be taken while dealing with court matters

   •     To make basic procedure as part of Standard Operating System so that cases pass the security of court proceedings. 

 

The course was delivered in such a way to cover intricacies of Tax Administration and General Administration, from the point of legality of various action taken.Resource Faculty of the course consisted of Justice S. The above mentioned Workshop took place on 10th April, 2015 at National Law University, Delhi. It was a collaborative academic activist exercise of and NLUD – SOAS combine within the UKEIRI framework.

 

The initiative was spearheaded by Prof. Philippe Cullet from SOAS who alongwith eminent expert panel from different parts of the country discussed in detail and critically analyzed the existing scenario on the subject matter especially the contemporary issues relating to linkages with climate change.

 

The day long Workshop was split into different sessions that saw the interactions of the experts through paper presentations (skype as well from Kathmandu that depicted breath taking imagery of Himalayan – Hindukush region on the crucial theme) and active dialogue and deliberations that culminated into number of meaningful suggestions and recommendations for law & policy reform in India on Groundwater Regulation and Management.

Workshop on Regulation and Management of Groundwater in the Age of Climate Change: Need for Legal Reforms in India.

This consultation is organised in the context of the UK-India Education and Research Initiative (UKIERI) project on ‘Climate Change and Groundwater Management: An Indian Law and Society Comparative Study’ jointly run by School of Law, SOAS – University of London and the National Law University, Delhi. The objective of the project is to build a long-term partnership between the two participating institutions and to research and work together in the area of environmental law, particularly the impact of climate change on groundwater and analyse and suggest improvements in the legal and policy framework.

Two workshops have already been conducted as part of this project in London (24-25 January 2014) and Delhi (21 June 2014).

The Centre for Transparency and Accountability in Governance at National Law University Delhi organised a two-day international conference on Transnational Corruption on 14th and 15th of March 2015.  The inaugural session was held on 14th March under the auspices of Hon’ble Mr. Justice A.K. Patnaik, former Supreme Court Judge, and Shri Paramjeet Singh Bawa, Chairman, Transparency International India. Prof. G.S. Bajpai, Registrar, National Law University Delhi, delivered the welcome address.Dr. J.S. Mann, Director of CTAG and Convenor of the Conference, spoke on the theme of the Conference – Transnational Corruption. Shri P.S. Bawa gave the inaugural address. He spoke on the history of Transparency International and its role in today’s world, especially in India. Further, Hon’ble Mr. Justice A.K. Patnaik delivered the keynote address touching upon various high-profile cases on corruption he dealt with during his career.Activists, lawyers, professors, professionals and paper presenters from all over India as well as some foreign countries took part in the Conference in various capacities.

 

The Conference witnessed lively participation and quality discussion from all the panellists, paper presenters and participants. The Conference saw seven technical sessions over the course of two-days wherein ideas were exchanged, problems identified, solutions suggested. Thirty Four Papers were presented by students, teachers and other professionals. Their ideas were questioned and discussed thoroughly followed with helpful suggestions.

 

The Conference was a huge success. It ended on a high with the Valedictory Session on 15th March.  The Session was chaired by Shri. P.S. Bawa, who spoke on the role of Transparency International India in controlling transnational corruption, and co-chaired by Shri Narinder Singh and Prof. S. Sachidanandam who spoke respectively on Effectiveness of treaties/covenants in controlling Transnational Corruption and Controlling Transnational Corruption under UNCAC, 2003.

 


ICC- Delhi Pre-VIS International Commercial Arbitration (March 5-8, 2015)

NLU Delhi Hosts the 5th Indian Vis Pre-Moot and ICC YAF Conference

National Law University, Delhi hosted the 5th Indian Vis Pre-Moot and the ICC YAF Conference from 5 to 8 March, 2015. The Indian Vis Pre-Moot is a preparatory competition for participants of the Willem C. Vis moots in Vienna and Hong Kong. This year, NLU Delhi joined hands with the International Chambers of Commerce in Paris and the West Bengal National University of Juridical Sciences, Kolkata.

 

 

To provide participants insight into the problem based on the concepts of Joinder of an Additional Party, Emergency Arbitrator and procedural and substantive issues regarding Letter of Credits, among other issues, the ICC YAF was organized on 5 March. The event saw an expert panel consisting of experienced professionals from Singapore, Hong Kong, Dubai and India debate these intricacies, which took questions from the participants as well.

 

The Pre-Moot featured participation from 21 teams, out of which several foreign Universities participated via the E-Moot facility, a revolutionary concept in Indian mooting. The event witnessed teams as far as from Australia taking part via E-Moot. Moreover, teams from as far as São Paulo, Brazil flew in for the rounds.

 

The competition commenced on 7 March with four preliminary rounds before tribunals comprising of at least two arbitrators. That evening, there was a break night at Lodi – The Garden Restaurant.

The quarterfinals began on 8 March, followed by the semifinals, in which HNLU Raipur (Vis Vienna) prevailed against NLS Bangalore (Vis Vienna), whereas University of São Paulo, Brazil (Vis East) outmatched NUJS Kolkata (Vis Vienna). In a finals tribunal comprising of Arbitrator Harish Salve, Arbitrator AK Sikri and Arbitrator Christopher Lau, HNLU Raipur (Vis Vienna) narrowly defeated University of São Paulo, Brazil (Vis East). The Best Oralist award was picked up by Aniruddha Basu of NLS Bangalore (Vis Vienna).


IV Annual IP Teaching Workshop- 2015

The IV Annual IP Teaching Workshop-2015 was organised by NLU, Delhi, in association with Centre for Advanced Study and Research on Intellectual Property (CASRIP), University of Washington School of Law, Seattle, United States, on 14th and 15th February, 2015

 

In 2012, the first such workshop identified several broad challenges faced by teachers of intellectual property law in India. In 2013 the workshop focus was on IP teaching techniques, use of information and communications technology in IP teaching, research and publication. The third workshop in 2014 discussed various issues on IP clinics.  All workshops have had key speakers and resource persons from India and abroad.

 

Now in its fourth year, by bringing together a select gathering of IP teachers from all over India, the 2015 workshop focussed on following agenda items:

 

·         -     Teaching methods for advanced or niche IP courses- This involved discussion on methods and techniques for teaching specialised courses such advanced patent law, IP and competition law & economics, practice-based IP teaching etc.

·         -     Empirical research in intellectual property – This theme deliberated on how IP law and policy can be informed by empirical research and how law teachers and researchers can contribute to such research. The presentations focused on designing and conducting empirical IP research, empirical IP research in the US and India, hurdles in empirical research.

·         -    IP clinics- It focused on contribution by the academia to law and policy – focus on how law teachers can actively contribute to IP law and policy by working with the government, interventions in judicial matters and by engaging with the civil society. The session also focused on how to start and run a successful entrepreneurial law clinic.

·         -    Teaching IP beyond law schools:  Experiences from technical, humanities and management schools was discussed. IP teachers in non-law institutes and their experiences- discussed how law school teachers can contribute and mutually benefit. Some aspects of blending technology with law were deliberated upon.

·         -    Engaging IP beyond classroom teaching: Activating IP teaching and research centres in different law schools, student participation activities, alternative publishing/ blogging activities etc.

 

 

Based on the experiences of the last few years, it was decided that an IP Society in India with an appropriate governance structure would help in shaping intellectual property education in India to higher levels of academic consciousness. The proposed society would broadly encompass the following categories: Teaching | Clinics | Research | Curriculum | Advisory Group on Policy | Amicus Briefs 

 

The IP teaching workshop is an annual feature has become one of the flagship events of NLU Delhi. This year there were around 20 participants from different parts of the country and an equal number of invitees and resource persons. 

 

Innovations in Indian IP teaching and Research with University of Washington & Microsoft.

 

Two days workshop on ‘Innovations in Indian IP Teaching and Research’ was held at NLU Delhi from 15-16 February, 2014 under the auspices of National Academy of Law Teachers in association with University of Washington School of Law, Seattle, U.S.A. and Microsoft. This workshop mainly focused on the Intellectual Property Teaching and research, fostering critical thinking in the area of IP law and policy, introduction to Clinical legal education and overview of clinics and scholarships in IP.  Discussions were also held on various teaching techniques, designing experiential courses in IP, research and institutional strategies for developing IPR teaching, research and policy and team based learning. The experiences and success stories of law teachers from India and the U.S. in teaching IP law and IP clinics were discussed by Prof. Jane Winn, Prof. Scott David, Prof. Bill Snyder and Prof. Debbie Maranville, of School of Law, University of Washington and Prof. Srikrishna Deva Rao, National Law University Delhi, Prof. Shamnad Bashir, NUJS Kolkata, Dr. Raman Mittal, Faculty of Law, Delhi University, Mr. Yogesh Pai, National Law University Delhi, Dr. Vishwas H., Jindal Global Law School, Mr. Ajay Pandey, Associate Professor, Jindal Global Law School from India. Challenges and opportunities in IP teaching in India and importance of use of new techniques and methods in teaching in IP were discussed in the workshop. The participants shared their views on clinical legal education in Intellectual property and research strategies for successful IP scholarships. Participants exchanged their ideas on various aspects IP scholarship and publishing in India and initiated the online repository of leading IP scholarship & research.
